Alux Travel Booking Terms & Conditions & Cancelation Policy

PRICES AND ARRANGEMENTS
Quoted journey prices are per person, except where indicated otherwise. Although not expected, published prices may be modified due to unexpected significant external factors not forecasted at the time of printing. Alux Travel is under no obligation to give a breakdown of the costs of any journey. Any modifications to a Tailor Made itinerary, including dates or number of people travelling, will require a revised proposal.
All rates quoted in this brochure or any other quotations by Alux Travel are based on current rates and tariffs and may change without prior notice due to fluctuating exchange rates and other factors beyond Alux Travel’s control. This includes increases in fuel above that which has been quoted as applicable to guided tours & fly-in safaris.
Alux Travel reserves the right to change the price of any Tour before departure to unforeseeable changes in the prices of factors such as accommodation price increases, new government legislation, etc.
If Alux Travel increases the price of a Tour, this additional amount must be paid to Alux Travel in full before the departure of the Tour. If this amount is not paid to Alux Travel, Alux Travel reserves the right to cancel the Tour, and the client will be liable for the charges per Alux Travel’s cancellation policy.
Alux Travel shall have the right to alter, at its discretion, the booking terms concerning the route, itinerary, and accommodation. Alux Travel shall endeavour to offer the client an alternative Tour of comparable standard. Should the Tour be of a lower standard, the client will be refunded the difference, but should there be an increase in the price, the client shall have the right to either reject the alternative or obtain a refund of the relevant portion of the original sum contracted or to accept the option and pay the increased cost. Suppose the client rejects the alternative Tour and claims a refund. In that case, such rejection shall be treated as a cancellation, and the refund will be calculated according to the “Cancellation Policy” of Alux Travel. The client shall have no claim against Alux Travel for any damages arising from the alternative booking.
CHILD POLICY
No minimum age is required unless noted on the itinerary, and an adult must accompany all children under age 18. Some accommodations need children below a certain age to share a room with an adult.
The parent or guardian travelling alone with a child must carry documentation that proves their relationship to the child (e.g., birth certificate) and evidence that they have permission to travel with the child (e.g., consent letter). Guests travelling with unrelated children must carry documentation that provides evidence they have permission to travel with the child. Guests are advised to check with the appropriate government authority to determine the documents required for travel with children. Alux Travel cannot be held responsible should the guest, child or any member of the travelling party be denied entry to a country due to non-compliance with a country’s requirements.
ACTIVE ELEMENTS & CONDUCT
The suppliers of some activities on journeys may require a minimum age or minimum/maximum height or weight to participate. Some active elements have been incorporated into select itineraries. To enjoy the trips as intended, a minimum fitness level is required. Alux Travel will require prior notice if any participant has any physical or other condition or disability that would prevent them from participating in active elements of any journey and could create a hazard to themselves or other members of the group. Specific trips may require a guest to produce a doctor’s certificate to Alux Travel before travel. Alux Travel will make reasonable efforts to accommodate a disability-related request for accommodation. However, suppose Alux Travel, in its sole discretion, adequately accommodates the need of the person(s) concerned or believes that health and safety may be compromised. In that case, Alux Travel reserves the right to refuse participation. The guest represents that neither he nor she nor anyone travelling with them has any physical or other condition or disability that could create a hazard to themselves or other tour members. Alux Travel also reserves the right to remove from the trip, at the guest’s own expense, anyone whose physical condition or conduct negatively impacts the enjoyment of the other guests or disrupts the tour.
RESERVATION AND PAYMENT SCHEDULE
Any payments to Alux Travel constitute your acceptance of the terms and conditions and, more specific pre-travel documentation, including the guest information form.
Alux Travel accepts all major credit cards.
CANCELLATION CHARGES
Cancellations must be received in writing and will become effective on the date of receipt, fax or email. Cancellations received by Alux Travel are subject to the following:
There will be no refund by Alux Travel if, for any reason, inclusions or parts of the Tour cannot be carried out and utilised. These would include all facets such as meals, accommodation, game drives, other activities, etc.
The guest agrees that the sums referenced in the cancellation provisions above are not a penalty and represent a reasonable effort on behalf of Alux Travel to establish its loss prospectively and represent liquidated damages. These include, amongst other costs but are not limited to, fees charged by hotels and travel suppliers to Alux Travel for cancelled bookings.
Changes to the Itinerary:
The guest will be responsible for any changes or cancellations made to the itinerary at their request or beyond their control, before or during travel, including expenses incurred due to a transformation, delay or cancellation of any flights.
CANCELLATION CHARGES FOR EXTRA SERVICES
Additional hotel nights and other extra services booked in connection with Alux Travel journeys are subject to specific cancellation penalties. These will be provided at the time of booking and noted on the invoice.
COVID-19 ACKNOWLEDGEMENT
Guest must provide required health documentation for travel and agree to comply with all health protocols as directed by Alux Travel staff during their journey. Noncompliance with these measures will result in an inability to travel or continue on the trip. Guest voluntarily assumes all risks and related expenses if they or any member of their travelling party require testing or quarantine, become infected with COVID-19 or experience travel interruptions or delays. Guest must follow the legal and regulatory requirements regarding COVID-19 testing and quarantine per individual country regulations. The testing procedures and results are solely subject to the control of local governments. Alux Travel has no power and authority to overrule, change, or amend local government policies relating to testing or providing private quarantine facilities. Alux Travel will assist all guests where COVID-19 testing is required; however, Alux Travel is merely acting as a facilitator to assist guests who need a COVID-19 test. Third-party testing facilities carry out all COVID-19 testing without association or affiliation with Alux Travel. Alux Travel is not liable or responsible for any results, issues, delays or problems encountered during the testing process or the performance or nonperformance of the testing facilities.
FORCE MAJEURE
Force majeure means unusual and unforeseeable circumstances beyond Alux Travel’s control or the control of our suppliers, the consequence of which neither Alux Travel nor its suppliers could avoid even with all due care, including, but not limited to, war or threat of war; riot; civil strife; terrorist activity (actual or threatened); industrial dispute; technical problems with transport, machinery or equipment; outages or power failures; natural or nuclear disaster; fire, flood, drought or adverse weather conditions; pandemics, epidemics or outbreaks of illness; and ice conditions in oceans and level of water in rivers.
In the event of a cancellation or material alteration to the journey as a result of the circumstances as described in this clause, Alux Travel may, in its sole and absolute discretion:
– offer the guest(s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances; or
– if Alux Travel does not offer alternative travel arrangements or products, Alux Travel will provide a travel credit to the guest equal to the value of the trip, less any sums Alux Travel cannot recover from any supplier.
Alux Travel cannot assume responsibility for other travel-related costs, including air, insurance, visas, travel arrangements, etc.
CLAIMS AND REFUNDS
Alux Travel will not accept any liability for any claims and will not provide refunds except as may be specifically allowed herein.
LIMITS ON ALUX TRAVEL’S RESPONSIBILITY
Alux Travel, its affiliates or subsidiaries, or any of their respective employees, shareholders, officers, directors, successors, representatives, agents and assigns (collectively “Alux Travel”), owns or operates any entity which is to or does provide goods or services for your trip. Alux Travel purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independents. All such persons and entities are independent contractors. As a result, Alux Travel is not liable for any negligent or willful act of any such person, entity, or third person.
In addition and without limitation, Alux Travel is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services, whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labour activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failures of aircraft or other means of transportation or for the loss of any transportation mechanism to arrive or depart on time.
There are many inherent risks involved in adventure travel, which can lead to illness, injury, or even death. These risks are increased because these trips occur in remote locations, far from medical facilities. Guest assumes all such risks associated with participating in these trips.
Suppose you decide to participate in any activities including, but not limited to, any excursions involving animals, riding on animals, scuba diving, snorkelling, boating, hot air ballooning, helicopter flights, ziplining, high altitude treks, climbing, quad biking, parasailing, parachuting, kayaking, whitewater rafting, jet boat rides, snowmobiling, primate tracking and any other activity which Alux Travel considers to can carry an inherent risk of serious illness, injury or death (“Activities”). In that case, you fully understand and acknowledge that Activities have with them various inherent risks, including serious illness, injury or death. You take complete responsibility for your health and safety and agree to assume all risks of injury, illness or death, whether foreseen or unforeseen, that may befall you as a result of participating in any Activities and agree to release Alux Travel from any liability whatsoever related to it.
Further, as consideration for being permitted to participate in the Activities; you release Alux Travel, whether known or unknown, from and agree not to sue or make a claim against Alux Travel for property damage, cancellation of any Activities for any reason, illness, negligent rescue operations or procedures, personal injury, or death arising out of your participation in the Activities, and any activity related to it, including transportation to and from the site of the Activities, regardless of whether such property damage, illness, personal injury, or death results from the negligence of Alux Travel and any defect in the equipment. You further agree to indemnify and hold Alux Travel harmless concerning any claim made against Alux Travel by anyone else that (a) related to your participation in any trip or any Activities or (b) which would be subject to the above release and covenant not to sue if you had made a claim directly yourself. Upon receipt of notice of a claim’s assertion, Alux Travel reserves the right to approve, or withdraw approval of counsel, in its sole discretion.
TRAVEL ADVISORIES/WARNINGS:
The guest’s responsibility is to become informed about the most current travel advisories and warnings by referring to the U.S. State Department or their respective government agencies. (https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories/namibia-travel-advisory.html) In the event of an active State Department or government agency Travel Warning against travel to the specific destination location(s) of the trip, should the guest still choose to travel, notwithstanding any travel advisory, the guest assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
Travel Insurance and Visas
The guest’s sole responsibility is to obtain and have the appropriate valid travel documents when necessary. All guests are advised to check with the proper government authority to determine the documents required for their travel. Passports must be valid for six (6) months after completion of your journey and should also have sufficient blank visa pages for entry and exit stamps. Citizens of other countries should contact the appropriate consular office for entry requirements for their journey. You may be refused to board or disembark from a plane, vessel or train without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation, and you will be subject to any fine or other costs incurred by Alux Travel which result from improper documentation or noncompliance with applicable regulations. Alux Travel shall not be responsible should any guest be denied entry to a country due to non-compliance with these requirements.
